Welcome to ROOM 33 STUDIO. These Terms and Conditions ("Terms") govern your access to and use of the website located at https://room33studio.com/ (the "Site"), the RESONATE 33 application, and all related design services provided by ROOM 33 INTERIOR DESIGN STUDIO LLC ("we," "us," or "our").

By accessing our Site, utilizing our applications, or purchasing our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or services.

ROOM 33 STUDIO provides premium digital, virtual, and select in-person interior design solutions. Our services include:

• Virtual interior design consultations
• In-person design consultations (Exclusively available within the State of New Mexico)
• Virtual staging and post-processing real estate image edits
• Expert color consultations
• Access to RESONATE 33, our AI Concept Engine

Service Limitations: While we offer in-person consultations for site assessments and measurements within New Mexico, all deliverables provided by ROOM 33 INTERIOR DESIGN STUDIO LLC remain conceptual in nature. We do not provide physical renovations, general contracting, or architectural engineering. Our deliverables (including 3D scans and AI concepts) are intended as visual guides and design directions rather than technical construction or structural documents.

 RESONATE 33 is an Al-powered interior design studio that transforms your space ideas into professional, cohesive design concepts. Get curated color palettes, material recommendations, and photorealistic visualizations—all tailored to your unique style.

• Usage: The application provides conceptual imagery and spatial directions based on user inputs. Outputs are generated for inspirational purposes.

• Beta Stage Disclaimer: RESONATE 33 is currently in its beta stage. Users may experience occasional inconsistencies, longer generation times, or evolving features as we refine the Lidar integration and AI models.

• Fees:

• FREE VERSION: 10 Free Concepts/ Month. Every user gets 10 Al-generated design concepts per month at no cost. Your free concepts reset on the first of each month. Color palettes & narratives, Material & spatial strategy, Key elements & lighting, Modify mood board (3 changes per concept.

• PREMIUM VERSION: Subscribe for $99/month to get unlimited concepts, PDF exports, wall paint codes, mood board downloads, and client sharing. Unlimited concepts per month, PDF exports, Wall paint codes & vendors, Mood board downloads, Unlimited mood board modifications and Share with clients for feedback.

To access specific services, including RESONATE 33 or community spaces like "The Talk" podcast-related chat, you may be required to create an account. You are responsible for maintaining the confidentiality of your credentials. We reserve the right to suspend accounts that violate these Terms or engage in unauthorized behavior.

• Consultations & Services: Payment for design consultations (virtual or in-person), virtual staging, and color palette creation must be made in full as outlined in the specific project invoice or checkout portal prior to the commencement of work.

• Cancellation Policy: Cancellations or rescheduling requests for virtual or in-person appointments made at least 24 hours before the scheduled time will receive a full refund or a one-time credit toward a future session.

• The "No-Show" Clause: Cancellations made with less than 24 hours' notice, or missed appointments, will result in the forfeiture of $125.00 USD for virtual consultations, $150.00 USD for In-Person Consultation in Albuquerque Area, $250.00USD for In-Person Consultation in Santa Fe Area. For other locations in the State of New Mexico, the forfeiture will based on half of the price quoted for the specific location where the In-Person Consultation was requested.

• Commencement of Work: Once our design team begins the architectural editing, staging, or custom design process, the order is considered "In Production" and the payment becomes non-refundable.

• Revisions: We offer up to 3 rounds of minor revisions to ensure the final result aligns with your vision.

All content on the Site, including text, graphics, logos, bold minimalist typography, and the RESONATE 33 interface, is the property of ROOM 33 INTERIOR DESIGN STUDIO LLC.

Deliverables provided to clients are licensed for personal or commercial real estate use. ROOM 33 STUDIO retains the right to use anonymized versions of generated images and promotional videos in our professional portfolio and "Style Secrets" series unless otherwise agreed upon in writing.

Our Site may contain links to third-party services (such as payment portals or social media platforms) not controlled by us. We hold no responsibility for the content, privacy policies, or practices of any third-party services.

To the maximum extent permitted by law, ROOM 33 INTERIOR DESIGN STUDIO LLC shall not be liable for any indirect, incidental, or consequential damages resulting from:

• Your use of the services or the RESONATE 33 app.
• Any physical implementations, renovations, or purchases you make based on our virtual or in-person conceptual designs.
• Any structural issues not identified during conceptual in-person consultations.

These Terms shall be governed and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law provisions.

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last Updated" date. Continued use of our services after revisions constitutes agreement to the updated Terms.
